Personal Data Processing Policy
1. General Provisions
This personal data processing policy has been drawn up in accordance with the Law of the Republic of Kazakhstan No. 94-V of 21 May 2013 “On Personal Data and Their Protection” and sets out the procedure for processing personal data and the measures taken by IE Hello Park Atyrau (hereinafter, the Operator) to ensure the security of personal data.
1.1. The Operator’s most important goal and condition for carrying out its activities is respect for the rights and freedoms of individuals and citizens when processing their personal data, including the protection of the rights to privacy and to personal and family secrets.
1.2. This Operator’s policy on personal data processing (hereinafter, the Policy) applies to all information that the Operator may obtain about visitors to the website https://hello-park.ru/atyrau/main.
2. Basic Terms Used in the Policy
2.1. Automated processing of personal data — processing of personal data using computer technology;
2.2. Blocking of personal data — temporary suspension of personal data processing (except where processing is necessary to clarify personal data);
2.3. Website — a set of graphic and information materials, as well as computer programs and databases that make them available on the Internet at https://hello-park.ru/atyrau/main;
2.4. Personal data information system — a set of personal data contained in databases, together with the information technologies and technical means that ensure their processing;
2.5. Depersonalization of personal data — actions as a result of which it is impossible, without additional information, to determine whether personal data belong to a specific User or another personal data subject;
2.6. Processing of personal data — any action (operation) or set of actions (operations) performed with personal data, with or without the use of automation, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (dissemination, provision, access), depersonalization, blocking, deletion and destruction of personal data;
2.7. Operator — a state body, municipal body, legal entity or individual that, independently or jointly with others, organizes and (or) carries out the processing of personal data and determines the purposes of processing, the composition of the personal data to be processed and the actions (operations) performed with personal data;
2.8. Personal data — any information relating directly or indirectly to an identified or identifiable User of the website https://hello-park.ru/atyrau/main;
2.9. User — any visitor to the website https://hello-park.ru/atyrau/main.
2.10. Provision of personal data — actions aimed at disclosing personal data to a specific person or a specific group of persons;
2.11. Dissemination of personal data — any actions aimed at disclosing personal data to an indefinite group of persons (transfer of personal data) or at making personal data available to an unlimited group of persons, including publication of personal data in the mass media, posting in information and telecommunication networks, or providing access to personal data in any other way;
2.12. Cross-border transfer of personal data — transfer of personal data to the territory of a foreign state, to an authority of a foreign state, or to a foreign individual or legal entity;
2.13. Destruction of personal data — any actions as a result of which personal data are irreversibly destroyed so that their content in the personal data information system cannot be restored, and (or) the physical media of personal data are destroyed.
3. The Operator May Process the Following Personal Data of the User
3.1. Name;
3.2. Email address;
3.3. Phone numbers;
3.4. The website also collects and processes anonymized data about visitors (including cookies) using web analytics services (Yandex Metrica, Google Analytics and others).
3.5. The above data are hereinafter collectively referred to in the Policy as Personal Data.
4. Purposes of Personal Data Processing
4.1. The purpose of processing the User’s personal data: processing the Client’s Orders and fulfilling obligations to the Client; promoting goods and services; evaluating and analyzing the performance of the Website; analyzing the Client’s purchasing preferences and providing personalized recommendations; informing the Client about promotions, discounts and special offers by email newsletters.
4.2. The Operator also has the right to send the User notifications about new products and services, special offers and various events.
4.3. The User may always opt out of receiving information messages by sending an email to the Operator at [email protected] marked “Opt-out of notifications about new products, services and special offers”.
4.4. Anonymized User data collected through web analytics services are used to gather information about Users’ actions on the website and to improve the quality of the website and its content.
5. Legal Grounds for Personal Data Processing
5.1. The Operator processes the User’s personal data only if the User fills in and/or submits them independently through the special forms on the website https://hello-park.ru/atyrau/main. By filling in the relevant forms and/or sending their personal data to the Operator, the User consents to this Policy.
5.2. The Operator processes anonymized data about the User if this is permitted in the User’s browser settings (saving cookies and using JavaScript are enabled).
6. Procedure for Collection, Storage, Transfer and Other Types of Personal Data Processing
The security of personal data processed by the Operator is ensured through the legal, organizational and technical measures necessary to fully comply with the requirements of the applicable personal data protection legislation.
6.1. The Operator ensures the safety of personal data and takes all possible measures to prevent access to personal data by unauthorized persons.
6.2. The User’s personal data will never, under any circumstances, be transferred to third parties, except in cases related to compliance with applicable law.
6.3. If inaccuracies in personal data are identified, the User may update them independently by sending a notice to the Operator’s email address [email protected] marked “Updating personal data”.
6.4. The period of personal data processing is unlimited. The User may withdraw consent to the processing of personal data at any time by sending a notice to the Operator’s email address [email protected] marked “Withdrawal of consent to personal data processing”.
7. Cross-Border Transfer of Personal Data
7.1. Before carrying out a cross-border transfer of personal data, the Operator must make sure that the foreign state to whose territory the personal data are to be transferred provides reliable protection of the rights of personal data subjects.
7.2. Cross-border transfer of personal data to the territory of foreign states that do not meet the above requirements may be carried out only with the written consent of the personal data subject to the cross-border transfer of their personal data and/or for the performance of a contract to which the personal data subject is a party.
8. Final Provisions
8.1. The User may obtain any clarifications on matters concerning the processing of their personal data by contacting the Operator by email at [email protected].
8.2. Any changes to the Operator’s personal data processing policy will be reflected in this document. The Policy is valid indefinitely until it is replaced by a new version.
